Casi un 34% de los contratos estatales solo participa una empresa y en un 65% de los contratos hay 3 o menos participantes. Estas cifras convierten a España en uno de los países europeos con menor participación de empresas en las licitaciones públicas, y una oportunidad para que empresas extranjeras puedan contratar con el Sector Público Español, consiguiendo sus contratos mediante licitación pública.

Immer mehr öffentliche Ausschreibungen werden elektronisch abgewickelt. Die elektronisch einzureichenden Unterlagen sind größtenteils identisch mit denen, die physisch im Register oder per Post vorgelegt werden, es sei denn, in einem elektronischen Angebot handelt es sich um virtuelle Umschläge. Ebenso ist es erforderlich, das Verfahren für die elektronische Abgabe von Angeboten in Serviceverträgen zu kennen, beispielsweise die korrekte Konfiguration des elektronischen Geräts, auch wenn die elektronische Vertragsplattform des öffentlichen Sektors zu Problemen neigt.
La propuesta que presenta una empresa en una licitación pública, es la oferta que dicha empresa realiza en relación a la demanda que se solicita en la licitación pública, puede ser una realizar una obra, prestar un servicio, servir un suministro, etc…
En la oferta, el licitador puede simplemente indicar el importe por el cual va a realizar la obra, prestar el servicio o servir el suministro, que es lo que se conoce como licitación pública tipo subasta, o también, en la oferta que presente, además del precio, describir qué características tiene esa obra, ese servicio o ese suministro ofrecido, que es lo que se conoce como concurso público.
La información que compone la proposición se puede dividir en dos grupos, la documentación administrativa, jurídica, profesional y habilitante, y la documentación relativa a la oferta económica y estudio técnico.
Los documentos que recogen la información que la empresa ofrece, tanto la proposición económica, como la proposición técnica (fruto del estudio técnico), se introducen en sobres, y estos sobres, junto con los documentos de la licitación en su interior, se depositan en el registro del Órgano de Contratación.
Es importantísimo redactar meticulosamente todos los documentos de la licitación y hacer los sobres según se establezca en los pliegos de la licitación, ya que si incumplimos alguna cláusula de estos, nuestra oferta será excluida del proceso de licitación pública, perdiendo todas las opciones de resultar adjudicatarios del contrato de obras, servicios o suministro.
Cada vez más licitaciones públicas de servicios se tramitan mediante licitación electrónica. Los documentos a presentar de forma electrónica son en su mayoría idénticos a los que se presentan de forma física en el registro o por correo postal, salvo que en una licitación electrónica los sobres son virtuales. Es igual de necesario conocer el procedimiento de presentación electrónica de las ofertas en contratos de servicios, como disponer del dispositivo electrónico correctamente configurado, aun así, la plataforma de contratación electrónica del sector público suele dar problemas.
